Based on what legal provisions are your personal data processed?
1. The principles regarding the protection of personal data (hereinafter referred to as ODO) are set out, among others, in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as GDPR), the Personal Data Protection Act in the national order and in special laws (lex specialis) also in the national order.
Who is the Administrator of your personal data?
2. Pursuant to Art. 12 and 13 of the GDPR, i.e. the right to be informed, we would like to inform you that the Personal Data Controller is Wrocławskie Przedsiębiorstwo Budownictwa Mieszkaniowego "MÓJ DOM" S.A., 53-333 Wrocław.

For what purposes may your personal data be processed?
3) Please be advised that the personal data provided are or may be processed for the following purposes:
a) preparing and sending an offer in response to your inquiry received by e-mail or telephone (e.g. using the contact form on the administrator's website),
b) sending commercial information, including marketing information, by electronic means or telephone in relation to own products and services. The legal basis for the processing of personal data is the consent of the data subject (Article 6(1a) of the GDPR) or the processing is necessary for the purposes of the legitimate interests pursued by the administrator or by a third party, except for situations where the overriding nature these interests have interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular when the data subject is a child (Article 6(1f) of the GDPR). A legally justified purpose is a contract or business implementation binding on the parties,
c) for contact purposes, i.e. providing answers and feedback to your questions regarding matters related to our products or services,
d) for purposes related to the implementation of the provisions of the contract where processing is necessary to perform the contract to which the data subject is a party, or to take action at the request of the data subject before concluding the contract (Article 6(1c) of the GDPR) ).
Is your personal data shared or entrusted?
3) Please be advised that your personal data may be transferred to data recipients (entities financing the purchase of real estate, notary offices, real estate community or manager, bank maintaining investment accounts), public authorities or entities under currently applicable legal provisions (e.g. tax office) and may be entrusted for processing pursuant to Art. 28 of the GDPR, to which the Administrator entrusted the processing of personal data (processor). Entities processing personal data on behalf of the Administrator may be: entities providing construction services, legal services, housing associations or real estate managers. The data administrator cooperates only with entities that meet the requirements of the GDPR and have implemented appropriate technical and organizational measures to secure the entrusted personal data.
Transferring your personal data to a third country (i.e. outside the EEA)
4) Please be advised that personal data is not transferred to a third country. In the event of transfer of personal data outside the European Economic Area, such transfer may only take place on the terms set out in Art. 46, art. 47 or 49 GDPR.
How long will your personal data be processed in accordance with the temporal principle?
5) You are informed that:
a) if we receive an inquiry from you regarding the preparation and sending of the offer, until the offer process is completed,
b) in the case of consent to receive commercial information, including marketing information, electronically or by telephone in relation to own products and services, for an indefinite period until an objection is raised. Withdrawal of consent in the case of receiving commercial information, including marketing, in relation to own products and services is possible at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal,
c) in the case of personal data left for contact purposes, until you are provided with comprehensive information on the inquiries received,
d) in the case of contracts, the period of personal data processing results from the provisions contained in the contract and the provisions of applicable law.
What rights does the data subject have?
6) You are informed about the right to request from the Administrator access to personal data relating to the data subject, rectification, deletion or limitation of processing or the right to object to the processing, as well as the right to transfer data.
Who is the supervisory authority?
7) You are informed about the right to lodge a complaint with the supervisory authority, i.e. the Inspector General for Personal Data Protection with its registered office at ul. Stawki 2 in Warsaw (as amended, i.e. to the Data Protection Office). In what circumstances is providing data a requirement and when is it voluntary?
8) Please be advised that providing personal data is:
a) voluntary, however, failure to provide personal data in order to prepare and send the offer electronically and/or by telephone will result in the inability to achieve these goals,
b) voluntary, however, failure to provide personal data in order to receive commercial information, including marketing information, regarding own products and services by electronic means and/or telephone, will result in the inability to achieve these goals,
c) in the case of processing personal data for contact purposes, providing personal data is voluntary, but failure to provide personal data will result in the inability to contact the data subject,
d) in the event of concluding a contract, providing personal data is a contractual condition, where failure to provide personal data will result in the inability to conclude the contract and implement the provisions contained therein.
Information about automated processing, including profiling
9) We would like to inform you that when accessing the Data Administrator's website, cookies are used (information on cookie rules: http://www.mojdom.com.pl/polityka_prywatnosci.pdf) or Google Analytics: (link to the Google Analytics regulations: https ://www.google.com/analytics/terms/pl.html) in order to adapt the website to the needs of users.
What is the source of the data?
10) Personal data is transferred directly from the data subject. If personal data is obtained indirectly from the data subject, we inform you about the source of the data (for example, from real estate agents cooperating with the Data Controller).
How do we secure personal data?
11) We would like to inform you that the Data Administrator has implemented appropriate technical and organizational measures to ensure the security of personal data processing, and in particular implements the security measures described in Art. 32 GDPR.
WPBM ‘MÓJ DOM’ S.A., in accordance with the Law on the Protection of Whistleblowers of 14 June 2024, announces the possibility of reporting violations of the law in writing, electronically, via a dedicated e-mail address sygnalista@mojdom.com.pl.
Notification of a breach of the law cannot be made anonymously. Anonymous submissions will not be considered by WPBM ‘MÓJ DOM’ S.A..
