REGULATIONS OF THE LOYALTY PROGRAM “My new neighbor”
§ 1 General Provisions
1) The Regulations define the principles, scope and conditions of participation in the loyalty program, hereinafter referred to as the “Program”.
2) The organizer of the Program is the company Wrocławskie Przedsiębiorstwo Budownictwa Mieszkaniowego ” Moje Dom” S.A. based in Wrocław at ul. Powstańców Śląskich 2-4, 53-333 Wrocław, entered into the register of entrepreneurs of the National Court Register kept by the District Court for Wrocław-Fabryczna in Wrocław, 6th Commercial Division of the National Court Register under the number 0000071986, NIP 8971169740, REGON: 930838281, with share capital in the amount of PLN 500,000.00, paid in full, hereinafter referred to as the “Organizer”.
§ 2 Glossary
The terms used in the Regulations mean:
1) Regulations – these Program Regulations,
2) Organizer – Wrocławskie Przedsiębiorstwo Budownictwa Mieszkaniowego “MÓJ DOM” S.A. based in Wrocław,
3) Premises – residential or commercial premises, excluding storage rooms, parking spaces and garage spaces,
4) Participant – a natural person with full legal capacity who is at least 18 years old on the date of joining the Program or a legal person who joined the Program in accordance with the conditions specified in the Regulations and who concluded a sales agreement with the Organizer in the form of a notarial deed and establishing separate ownership of the Premises,
5) Parties – Organizer and Participant,
6) Recommended – a natural person with full legal capacity, who is at least 18 years old on the date of joining the Program or a legal person indicated by the Participant, to whom the Participant recommended the purchase of the Premises from the Organizer and who has not had any contact with the Organizer so far and is a potential buyer of the Premises offered by the Organizer during the Program,
7) Offer – all Premises owned by the Organizer and intended for sale,
8) Program – a loyalty program whose aim is to introduce, under the conditions specified in the Regulations, a system of granting a cash discount to Program Participants for the purchase of a Recommended Premises from the Organizer’s Offer, with the aim of intensifying the sales of Premises owned by the Organizer, strengthening good relations with the Organizer’s Customers and acquiring new contractors by the Organizer,
9) Application form – a document, the template of which is Annex 1 to these Regulations, which confirms the participation of Participants and Recommended Participants in the Program, containing identification data of the Participants and Recommended Persons.
§ 3 Participation in the Program
1) The Program is addressed only to Participants who meet the conditions provided for in the Regulations.
2) Participation in the Program is voluntary and free of charge.
3) The Participant may join the Program at any time during its operation.
4) The Organizer’s employees, related entities (within the meaning of the law) and their close persons cannot participate in the Program.
5) The Participant may participate in the Program personally or through a proxy, and his/her rights resulting from participation in the Program are not transferable to other persons.
6) The Participant cannot designate himself or herself as a Recommended Person.
7) The number of Recommendations indicated by the Participant is unlimited.
8) The program covers premises included in the Organizer’s Offer.
§ 4 Duration of the Program
1) The program lasts from October 17, 2016 to December 31, 2024.
2) The Organizer reserves the right to cancel or suspend the Program at any time, without giving a reason, after publishing information about the exact date of cancellation or suspension of the Program on the website www.mojdom.com.pl.
3) In the event of cancellation or suspension of the Program, in the manner described in point 2 above, from the moment of its cancellation or during the period of its suspension, the Participant may not invoke the rights arising from the Regulations.
§ 5 Rules of participation in the program
1) The Program is intended for Participants who:
a) express their willingness to participate in the Program,
b) complete the Application Form legibly and completely,
c) submit to the Organizer an application form completed in the manner described in point b) above.
2) The application form template is available on the website www.mojdom.com.pl and at the Organizer’s office.
3) The application form should be submitted to the Organizer’s office. Sending it to the Organizer’s office by registered mail or courier is considered equivalent to submitting the Application Form at the Organizer’s office.
4) The date of joining the Program is the date of receipt of the Registration Card by the Organizer.
5) The application form should contain at least:
a) name and surname/name of the Participant and Recommended,
b) address of residence/registered office of the Participant and Recommended,
c) contact telephone number and e-mail address of the Participant and Recommended,
d) consent of the Participant and Recommended to the content of the Regulations,
e) consent of the Participant and Recommended to the collection and processing of personal data by the Organizer for the purposes of participation in the Program in accordance with the Act of August 29, 1997 on the protection of personal data,
f) legible signature of the Participant and Recommended, including name and surname,
g) Participant’s date of birth,
h) PESEL/NIP of the Participant,
i) details of the Participant’s Tax Office,
j) details of the Participant’s bank account.
6) By completing the Application Form, the Participant and the Recommended agree to the content of the Regulations and undertake to comply with them.
7) The Organizer reserves the right to reject the Application Form if it is completed incomplete or illegible, if the authorized person fails to sign it or if the authorized person does not consent to the processing of personal data for purposes related to participation in the Program.
8) Rejection of an Application Form in accordance with point 7) above does not oblige the Organizer to inform the Participant who submitted such an Application Form about its rejection or about the reasons for such rejection.
§ 6 Resignation from the Program
1) The Participant may resign from his/her participation in the Program at any time after informing the Organizer in writing. Upon submission of such a declaration, all Participant’s registration cards collected on such Participant’s account will be canceled and his or her personal data will be deleted from the Organizer’s data collection.
2) The day of resignation is considered to be the day the Organizer receives the Participant’s written declaration of resignation from the Program.
3) The declaration referred to in point 2) above should be submitted to the Organizer’s office. Sending the declaration to the Organizer’s office by registered mail, courier or e-mail is considered equivalent to submission at the Organizer’s office.
§ 7 Personal data
1) The Participant undertakes to inform the Organizer about changes in his/her personal data and other data contained in the Application Form within 3 days from the date of these changes. In the event of failure to notify about changes to these data within the above deadline, the Organizer is not responsible for any delay or inaction caused by failure to update the data. Moreover, sending correspondence by the Organizer to the Participant’s current address will result in delivery.
2) By completing the Application Form, the Participant and the Recommended agree to the collection and processing of their personal data by the Organizer for the purposes of participation in the Program in accordance with the Act of August 29, 1997 on the protection of personal data.
3) Providing personal data and consenting to their processing is voluntary. Refusal to provide personal data and consent to their processing for the purposes of implementing the Program makes it impossible to join the Program and take part in it.
4) The Participant and the Recommended have the right to access their personal data provided as part of their participation in the Program and to correct, update, modify or rectify them.
§ 8 Granting a cash discount to the Participant
1) The Organizer undertakes to grant the Participant a cash discount for the purchase of the Recommended Premises from the Organizer’s Offer.
2) The Participant is entitled to the cash discount referred to above in the amount of PLN 2,000.00 for the purchase of the Recommended Premises from the Organizer’s Offer.
3) In the event of purchase of the Premises by the Recommended on the basis of co-ownership in fractional parts or joint co-ownership, the Participant is entitled to a nominal amount of PLN 2,000.00 regardless of the number of Recommended persons purchasing a given Premises.
4) The cash discount will be granted only after the Recommended Person concludes a development agreement with the Organizer or a preliminary sales agreement for the Premises and the Recommended Person pays the first installment of the sales price for the purchased Premises.
5) The Participant will be informed about the granting of a cash discount by registered mail or electronically by the Organizer within 7 days from the date of making the payment referred to in point 4) above to the Organizer’s bank account.
6) Payment of the cash discount granted to the Participant will be made to the Participant’s bank account indicated in the Application Form within 14 days from the date of informing the Participant about granting this discount.
7) The cash discount granted to the Participant will be withdrawn in the event of the Participant’s resignation from participation in the Program referred to in § 5 point 5, failure to provide the data referred to in § 5 point 5 in the Application Form and in the event of failure to inform the Organizer about the change. Participant’s data referred to in § 7 point 1.
§ 9 Complaints
1) The Program Participant has the right to submit complaints regarding the Program throughout the entire duration of the Program, as well as within 14 days from the end of the Program.
2) Complaints referred to in point 1) above must be submitted in writing to the Organizer’s office. Sending it to the Organizer’s office by registered mail, courier or e-mail is considered equivalent to submitting a complaint to the Organizer’s office.
3) Each complaint should include: name, surname, address of the Participant, e-mail address, as well as a description and reason for the complaint and the signature of the person filing the complaint.
4) Complaints will be considered by the Organizer within 14 days from the date of receipt.
5) The Participant will be notified about the consideration of the complaint by letter or electronically no later than within 7 days from the date of consideration of the complaint by the Organizer.
6) The Organizer’s decision regarding the complaint is final.
§ 10 Final provisions
1) These Regulations are valid from October 17, 2016 and are published on the Organizer’s website: www.mojdom.com.pl.
2) The Organizer reserves the right to change the Regulations during the Program. The amended Regulations will be available at the Organizer’s office and on the website: www.mojdom.com.pl 7 days before the entry into force of the amended Regulations.
3) Participation in the Program does not create any other obligations on the part of the Organizer apart from those expressly indicated in these Regulations.
4) A Participant invoking the rights resulting from participation in the Program is bound by the content of the Regulations in the wording at the time of invoking the above-mentioned. right.
5) Tax liabilities related to the granted cash discount are borne by the Organizer in accordance with the tax regulations applicable in this respect. The participant will receive a tax settlement certificate.

7) Any disputes arising from these Regulations will first be resolved amicably. In the event of disagreement between the Parties, the court competent to hear the case will be the court competent for the registered office of the Organizer.
